IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

IN ANY CASE, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some states do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you.

The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Subject to the Dispute Resolution section below, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the federal or state courts of competent jurisdiction located in the applicable state of Jet's Pizza's principal place of business. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue of any such action in such courts.

These Terms are subject to all applicable federal laws of the United States, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive acts and practices, the Electronic Communications Privacy Act (18 U.S.C. § 2510 et seq.), the Computer Fraud and Abuse Act (18 U.S.C. § 1030), and the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.).

For users located in the State of California, additional rights and protections may apply under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) (Cal. Civ. Code § 1798.100 et seq.), the California Consumers Legal Remedies Act (Cal. Civ. Code § 1750 et seq.), and other applicable California state laws.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website ("Dispute") informally by contacting Jet's Pizza at [email protected]. We will attempt to resolve the Dispute informally by contacting you via email. If the Dispute is not resolved within thirty (30) days of the initial informal notice, either party may proceed to formal dispute resolution as described below.

10.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT AND DISPUTES CONCERNING OUR INTELLECTUAL PROPERTY RIGHTS, YOU AND JET'S PIZZA AGREE THAT ANY DISPUTE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION CONDUCTED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT www.adr.org. THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

The arbitration shall be conducted in English, and the arbitrator shall apply the substantive laws of the applicable jurisdiction as set forth in Section 9. The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award, including injunctive relief, except that the arbitrator may not award declaratory or injunctive relief benefiting anyone other than the parties to the arbitration.

10.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Jet's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10.4 Jury Trial Waiver

BY AGREEING TO THESE TERMS, YOU AND JET'S PIZZA EACH WAIVE THE RIGHT TO A JURY TRIAL FOR ALL DISPUTES TO THE EXTENT PERMITTED BY APPLICABLE LAW.

10.5 Time Limitation on Claims

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE. ANY CLAIM NOT FILED WITHIN THIS TIMEFRAME SHALL BE PERMANENTLY BARRED. THIS PROVISION DOES NOT APPLY WHERE PROHIBITED BY APPLICABLE LAW.

14.1 Entire Agreement

Jet's Pizza shall not be liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemic, pandemic, war, terrorism, labor disputes, governmental actions, power outages, internet service provider failures, or third-party service disruptions.

14.4 No Third-Party Beneficiaries

These Terms are for the sole and exclusive benefit of the parties hereto and are not intended to confer any rights, benefits, or remedies upon any third party, except as expressly provided herein.

14.5 Electronic Communications
